- Represented former National Geographic photographer in significant copyright infringement suit against textbook publisher, obtaining a six-figure damages award, including $100,000 in statutory damages for single copyright violation. Defeated defendant’s post-trial motion to set aside verdict and successfully defended judgment on appeal. In a landmark decision, the Second Circuit Court of Appeals ruled that an award of statutory damages is not limited by the copyright owner’s actual damages and confirmed that the “discovery rule” applies to copyright infringement claims, rejecting contrary rulings by numerous lower-court rulings in the Circuit.
